GDBIKES4U.COM BICYCLE HIRE AGREEMENT
I hereby acknowledge and agree to the following rental agreement terms and conditions:
Customer has inspected the bicycle before signing this agreement and has checked the bicycle is in a satisfactory and safe condition and fit for purpose.
Customer accepts that a cycle helmet has been provided and should the customer decide not to use it then he/she accepts full responsibility. The customer has inspected the helmet and any other equipment provided prior to signing this agreement for any damage or defects.
Bicycles are rented out clean and in proper working order and must be returned in the same manner.
The customer understands that in the event of a mechanical failure during the rental period, GDBIKES4U.com will offer a collection service but reserves the right to charge a fee.
Customer agrees to return the bike in clean, UNDAMAGED condition to avoid any ADDITIONAL CHARGES for repair or replacement. Customer accepts use of equipment, as it, in good condition and accepts full responsibility for the care of the equipment while under his/her possession. Damaged parts or components will be repaired/replaced by GDBIKES4U.com, at their discretion and the customer agrees to pay the regular shop rates and retail prices for components replaced. Clean condition means normal wear and tear is acceptable but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes. Late returns are subject to fees. The customer will be charged the daily rental rate for each day pass the agreed bicycle return date.
The customer agrees to provide GDBIKES4U.com with an agreed deposit, which will be fully refunded on the return of the bicycle (subject to the terms and conditions set out in the hire agreement).
I authorize GDBIKES4U.com to withhold/deduct my deposit with any costs on case of damages to the bicycle during my rental period. In case of theft I will be responsible for reimbursing GDBIKES4U.com for the original price of the bicycle, plus the cost of any accessories that were provided at the time of the bike rental.

ASSUMPTION OF RISK, WAIVER AND RELEASE AGREEMENT
Assumption of risk: I understand and accept that renting this bicycle and participating in cycling exposes me to many hazards that may entail unavoidable risk of death, personal injury and loss or damage to property. I also understand I should be in good physical health to participate in cycling, and I confirm that I have no significant issues that prevent me from participating in cycling. I have no medical conditions, nor have I been diagnosed with a condition that prevents me from cycling. In spite of the aforementioned risks and acknowledgements, I hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting this bicycle and participating in cycling. I understand the inherent risk involved in using this rental cycling equipment and accept full responsibility for any and all such damage or injury which may result.
Waiver and Release: In consideration of GDBIKES4U.com renting me this bicycle, I specifically release and forever discharge GDBIKES4U.com and its affiliates, officers, agents and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this bicycle and participating in cycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by negligence of GDBIKES4U.com, officers, affiliates agents,or employees. It is my intend by the Waiver and Release agreement to release GDBIKES4U.com and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of GDBIKES4U.com or whether based upon the breach of contract, breach of warranty, or any other legal theory. In renting this bicycle or participating in cycling, I will have no right to make a claim against GDBIKES4U.com or its affiliates, officer, agents, or employees, even if they or any of the negligently cause my injury, illness, death or damage.
I HAVE CAREFULLY READ THIS AGREEMENT IN ITS ENTIRITY AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
